Walt Disney Parks and Resorts has dropped the federal appeal of a First Amendment lawsuit against Florida Governor Ron DeSantis. The action comes after the approval of a Development Agreement between Walt Disney World and the Central Florida Tourism Oversight District (CFTOD) on Wednesday.

Based on the new Development Agreement between appellant Walt Disney Parks and Resorts, U.S., Inc. (“Disney”) and appellee Central Florida Tourism Oversight District, Disney has agreed to dismiss the above-captioned appeal. All parties to this appeal hereby stipulate to dismissal of the appeal with prejudice. All parties agree to bear their own costs on appeal.
The appeal of the First Amendment lawsuit was the final carrot to be dangled following a “win-win” settlement that saw lower court actions tossed out. The voluntary dismissal of the appeal effectively marks the end of a chapter of tension between the state of Florida and Walt Disney World that began when Disney spoke out against the “Don’t Say Gay” bill.
Disney has ceded the moral high ground and has resumed political contributions in the state, including to a lawmaker who voted for the “Don’t Say Gay” bill. Back to business as usual.
