Judge Allen Winsor has filed an order in the Disney vs DeSantis federal case saying that neither Disney nor DeSantis provided a reasonable timeline for the trial. As you may recall, DeSantis wanted to delay the trial until after the 2024 Presidential Election, whereas Disney wanted a more speedy trial.
In a June 27th joint filing, the following timelines were offered for the court’s consideration:
- Disney (Plaintiff)
- Initial disclosures by July 18, 2023
- Fact discovery completed by January 15, 2024
- Expert disclosures made by January 15, 2024
- Expert discovery completed by March 15, 2024
- Trial date of July 15, 2024
- DeSantis (Defendant)
- Initial disclosures by September 18, 2023
- Fact discovery completed by January 3, 2025
- Expert disclosures made by January 3, 2025
- Expert discovery completed by March 14, 2025
- Trial date of August 4, 2025
In an order filed late last month, Judge Winsor said that “it is not clear that either proposal is reasonable under the circumstances” and said that the pending Motion to Dismiss briefing would be completed by August 9, 2023 and the court would not set a litigation schedule until that Motion to Dismiss was resolved.
Florida Governor Ron DeSantis is currently running for President of the United States and using Disney and his fight with them as fodder for his campaign speeches.
Recently, a journalist advocacy group filed an argument in support of Disney’s First Amendment allegations against DeSantis.
