Disney Warns Florida Governor Ron DeSantis That A New Lawsuit is Coming This Week

    In the ongoing legal battle between Florida Governor Ron DeSantis and Walt Disney World, a new report says that Disney could file another lawsuit against the state this week. According to the New York Times, Disney has sent letters to the governor’s office and other state entities saying that the company will file a new lawsuit if the state doesn’t comply with its own Public Records Act.

    According to Disney, they put in a public records request nearly four months ago, seeking “all documents and communications, including but not limited to text messages, Signal messages and WhatsApp messages on any devices” containing the words “Disney”, “mouse”, and other keywords. Disney says they have not received any records or substantive response asserting any valid exemptions under the law in nearly four months.

    Disney gave the governor a deadline of September 6th before they file a new lawsuit.

    As a reminder, Disney is already suing DeSantis in federal court, claiming that the governor and his state Legislature violated Disney’s First Amendment rights by using state might to retaliate against Disney for Disney’s protected free speech against the “Don’t Say Gay” law. Disney says that DeSantis and the Legislature collaborated to create a “targeted campaign of government retaliation—orchestrated at every step by Governor DeSantis as punishment for Disney’s protected speech”.

    Disney says that the actions taken by DeSantis and the Legislature jeopardize its economic future in the region and that the actions violate Disney’s constitutional rights. Disney says that the reconstitution of the Reedy Creek Improvement District has chilled and continues to chill Disney’s free speech. Disney notes that it has a significant interest in the composition and structure of the governing body of the District that the flagship Walt Disney World Resort resides in. Disney notes that the bills that first aimed to dismantle the RCID and then significantly change the governing structure were retaliatory in intent and that the bills would not have been introduced or signed into law were it not for the Governor’s desire to punish Disney for its protected First Amendment free speech against the “Don’t Say Gay” law.

    Florida Governor Ron DeSantis is no stranger to criticism of the secrecy of his government. A report from NBC News said that DeSantis’ office has “routinely stonewalled the release of public records” and “approved a slew of new legal exceptions aimed at keeping more information out of the public eye”. Michael Barfield, director of public access for the Florida Center for Government Accountability said that during DeSantis’ term, the state of Florida has “quickly become one of the least transparent [states] in the space of four years”.

    1. Disney is comically going to pay to discover documents it already has. The lawsuit only serves to impede their lawsuit that will fail.
