Disney & DeSantis’ Oversight District Agree to June Trial Date in Public Records Act Lawsuit

In a brief court appearance this morning, lawyers for Disney and the Central Florida Tourism Oversight District agreed to a preliminary timeline for the Public Records Act lawsuit brought by Disney against the District.

In short, Disney has alleged multiple Florida Public Records Act violations by the District, including the failure to retain records and the failure to retrieve records. Disney also alleges that the District may have destroyed records and that the District is improperly withholding records.

The lawyers appeared to have communicated outside of the court, and both sides were in agreement on presenting the following pre-trail timeline to the judge. This is the timeline of deadlines as outlined by Disney’s counsel, pending acceptance and an order from the judge:

  • February 23rd | Amended pleadings, preliminary injunctive relief, motions
  • April 12th | Completion of facts and expert discovery
  • March 1st | Serve requests for production & admissions
  • Mid-to-Late March | Mediation (if necessary or agreed to)
  • June 17th | Pre-trail conference
  • June 24th | Trial begins, 3 days maximum

Keep in mind that this lawsuit is in addition to a recent Motion to Compel Discovery filed by Disney in another lawsuit and heard in court earlier this week. The judge in that case has not ruled on Disney’s Motion to Compel Discovery yet.
