The lawsuit over an alleged trip and fall incident on the Main Street USA trolley tracks has ended. Plaintiff Rhonda Smith filed a notice of voluntary dismissal with prejudice this week. Here’s the latest.

Smith filed the dismissal notice with the Ninth Judicial Circuit Court in Orange County this week. Her attorney at Morgan & Morgan Orlando submitted the filing on her behalf. It dismisses the case “in all counts” against Walt Disney Parks and Resorts U.S., Inc. A dismissal with prejudice means Smith cannot refile the same claims against Disney in the future. The case is now permanently closed.
The notice doesn’t state a reason for the dismissal. It also doesn’t reference a settlement, although one is certainly possible. It simply confirms that both sides will cover their own fees and costs, rather than one side paying the other. That is common in cases resolved by agreement. Still, we don’t know the specific terms behind Smith’s decision to drop the case.
As we reported when the lawsuit was first filed, Smith alleged that she tripped and fell on the Main Street USA trolley tracks. Her foot got caught on or in the embedded track, and she says the fall caused serious injuries. Smith was seeking more than $50,000 from Walt Disney World over the incident. She said it happened around 5pm on October 24th, 2025, ahead of nighttime crowds and parade operations.
Disney filed its answer to the complaint in early February, as we detailed at the time. The company called the tracks “open and obvious” and argued that Smith was negligent. Disney said she failed to pay adequate attention to her surroundings. At that point, Disney had requested a jury trial. The court had set a trial date for November 22nd, 2027. Smith’s dismissal means that trial will no longer take place.
The trolley tracks remain on Main Street USA, where it is not uncommon to see guests struggle to navigate them.
