Disney has filed a Motion for Entry of Protective Order in the state-level lawsuit brought against Disney by the Central Florida Tourism Oversight District. While the federal-level lawsuit heads to an appeal after Disney lost the case, the state-level lawsuit appears to be moving along normally.

In the state-level case, Disney is awaiting a ruling from a judge on whether or not the District will be forced to produce documents that Disney says the District is illegally holding back. Disney has separately opened a Public Records Act lawsuit against the District, but while that’s related to the state-level case, it is a standalone lawsuit and not part of the scope of this article.

Yesterday, Disney entered an unopposed Motion for Entry of Protective Order to ask the judge to seal certain documents produced by the Company during the normal process of the Discovery process in the case. The judge agreed and entered a protective order. The protective order will not prevent Discovery, but it will limit who can access certain documents.

In the Motion, Disney says that certain documents it produces to the District should be sealed and hidden from public view. Disney says that the “disclosure of confidential information, including trade secret and other nonpublic technical, commercial, financial, personal, and other sensitive information, the disclosure of which could result in significant harm to the producing party’s personal rights or business operations”.

Essentially, the order says that any information marked by a party in the lawsuit as “Confidential” or “Highly Confidential” will have access and disclosure restrictions surrounding it.
