Disney: DeSantis’ Oversight District Retaliation Extended to Public Records Requests

    Disney has filed new documents in the ongoing public records requests lawsuit that it brought against the Central Florida Tourism Oversight District last December. In the lawsuit, Disney is alleging multiple public records request violations, including a failure to produce records, a failure to retain records, and a failure to retrieve records – all in violation of Florida’s Public Records Act.

    In the newly filed documents, Disney defends its request for immediate injunctive relief by the court. Disney is asking the court to provide immediate injunctive relief and instruct the CFTOD to make full forensic images of personal devices of departing employees and Board Members, instruct employees to disable auto-delete functions on personal devices, prohibit employees and Board Members from using external messaging applications with auto-delete functions.

    In emails between Disney’s lawyers and CFTOD counsel from January, Disney’s lawyer says that earlier communications from the CFTOD “indicate that you are treating public records requests from [Disney] differently than from others, in a retaliatory manner”.

    As you might recall, it was Disney CEO Bob Iger who first said that Disney was at the receiving end of retaliation. Last April, in the Annual Meeting of Shareholders, Iger said that DeSantis “decided to retaliate against [Disney]” after stripping Disney of voting rights and installing his own hand-selected Board to oversee the local taxing district enveloping Disney.

    The timeline for this lawsuit calls for the completion of all fact and expert Discovery by April 12th, and a trial date of June 24th.

    A separate lawsuit between the parties has recently been rescheduled for a July 25th hearing date, meaning both parties will continue to be in litigation for months to come. A third lawsuit is currently moving through the appeals process as well.

    1. Just as with desantis hiding his travel expenses (paid for by Florida tax players, so we have a right to know where our tax dollars are going), the GOP here in Florida (and their supporters) like to wield the power of their governmental positions unequally.

      But that’s not a surprise, considering the way trump applies double standards to everyone he doesn’t like.
