Lawsuit Refiled Against Florida Governor Ron DeSantis Over Dissolution of Reedy Creek Improvement District

A lawsuit that was previously dismissed by a federal judge has been refiled with the Eleventh Judicial Circuit Court in Miami-Dade County (via Orlando Business Journal).

The lawsuit alleges taxpayer rights violations are being caused by Florida Governor Ron DeSantis’ law targeting the dissolution of special districts made before 1968. There is reportedly $1 billion of debt that would need to be absorbed by the counties that would take over the Reedy Creek Improvement District according to current law. However, DeSantis said that he’s intent on the state taking control of the Reedy Creek Improvement District. DeSantis also says that he will get Disney to pay the debt, although they are under no obligation to foot the bill under current law.

Attorney William J. Sanchez says that he hopes that the newly refiled lawsuit will have a better chance of success in a state court instead of a federal court.

We truly believe we are on firm footing before the state court. The federal court judge viewed the case more through the prism of the First Amendment argument which is Disney’s to make. Although there is case law that also gives third parties rights to raise another party’s First Amendment rights, we chose to not appeal the federal judge’s decision. We believe our Florida taxpayer rights are going to receive greater protection in state court.
